Terms of Use for Users of the Davidson Institute of Science Education Website

Welcome to the website of the Davidson Institute of Science Education at the Weizmann Institute of Science (Nonprofit Organization), hereinafter, jointly and severally: “the Website” and “the Institute”) at the address https://davidson.org.il/. The Website is managed and operated by the Institute, and they are made available for use by users (hereinafter: “the User(s)” and/or “you”) in accordance with these terms of use. These Terms of Use are written in the feminine form for convenience only, are intended for all genders and refer to all genders, and are not intended to harm or create any discrimination. Entry to the Website, browsing it, use of its services and any other use of the Website are subject to these terms of use and to our privacy policy at [link to Privacy Policy] (hereinafter, together: “the Terms” or “Terms of Use”). Entry to the Website, browsing it, use of any of the services it offers (hereinafter, together: “the Services”) or any other use of them, indicate your consent to the Terms of Use, and you agree that the Terms will bind you and that you will act in accordance with all laws and regulations applicable in connection with the use of the Website. Please read the Terms carefully before browsing the Website or making any other use of them. Please also make sure to return and read them from time to time as they may change. If you do not agree to the Terms of Use, you are requested to leave the Website and not use it in any manner whatsoever.
1. General
1.1. The following terms of use apply to use of the Website only. However, the term “the Website” refers to the Website in all its parts and to the content of the Website of any kind and type whatsoever, including all information and content contained in the Website, whether visible to users or not. Also, the term “the Website” shall also refer to parts of the Website accessed through other addresses and similar domain names.
1.2. Use of the Website for any purpose whatsoever is subject to the terms in this document and in the privacy policy. Use of the Website shall be deemed consent by the user to all terms, conditions and notices contained in this document and in the privacy policy. Therefore, by using the Website (including any content appearing therein) the user declares that she has read and understood the privacy policy documents and the terms of use, and agreed to their terms. The Terms of Use Agreement together with the privacy policy are a binding legal document between the user and the Institute (each of them, jointly and severally).
1.3. The Institute reserves the right to change these terms of use at any time and in accordance with its sole discretion, and requests all users to revisit this page as frequently as possible. Changes to the Terms of Use Agreement shall take effect on the last update date of the document, and continued use of the Website after the last update date shall constitute the user’s consent to the changes. If the Terms of Use Agreement is amended to comply with any legal requirement, the amendments may take effect immediately or as required by law. It is your responsibility to check the Terms of Use Agreement and its update date from time to time.
1.4. The terms of use apply to the use of the Website and the content contained therein through any computer or other communication device (such as a mobile phone, tablet, etc.). The terms of use also apply to the use of the Website whether through the Internet or through any other network or means of communication.
1.5. The binding and determining version of the terms of use at any time is that published on the Website. The terms of use are cumulative and not alternative, and they shall be interpreted as coexisting side by side and not limiting one another. It is clarified that the user is entitled to choose to view part of the information and/or products and/or services offered on the Website and not all of them. Also, some of the services offered on the Website may not yet be active, and they will be made available to the user when they are activated.
1.6. In any contradiction between these terms of use and any other publication, the provisions of these terms of use shall prevail, unless expressly stated otherwise.
2. Description of the Website
2.1. The Website is primarily intended to provide scientific information, scientific educational information, information about scientific educational activities (“Activities”) and information about the activities of the Davidson Institute of Science Education. The Website includes extensive information in various fields, including links to sub-sites of units operating under the Institute and to the Weizmann Institute of Science website.
2.2. The Website also includes information services (newsletters), and additional tools and services such as: online registration for certain activities, talkbacks that allow responses to some of the content published on the Website, and more (“Services”). Some of the services and activities are subject to additional terms beyond the terms of use, such as: regulations, registration terms and more, and they apply in addition to them.
2.3. The Website, including its content and services, is offered for use as is, with its features and limitations, and you shall have no claim, demand or requirement against the Institute or anyone on its behalf regarding the Website’s features, its limitations or the possibilities existing therein, or in connection with its suitability for your needs and requirements.
2.4. In addition, the Website includes, among other things, any other content related to the group, such as videos, texts, files, logos, images, data collection, links, customized content, technical information, documentation, know-how, specifications, designs, data, the “look and feel” of the Website, algorithms, source and object code, interfaces including user interfaces, GUI, interactive features, graphics, illustrations, drawings, animations, user content (as this term is defined below), and other features and characteristics available on or through the Website (hereinafter, together: “the Content”).
2.5. All rights in the Website and/or in the content appearing on the Website are reserved to the Institute or licensed to them lawfully. The Website, including its content and services, is offered for use as is (“AS IS”) with its features and limitations, and you shall have no claim, demand or requirement against the Institute or anyone on its behalf, regarding the Website’s features, its limitations or the possibilities existing therein, or in connection with their suitability for your needs and requirements. The Institute shall not be liable for any damages caused to you or to any other person as a result of or in connection with your use of the Website and/or the Content. Your use of the Website and/or the Content is at your sole responsibility.
2.6. The information on the Website does not constitute professional, scientific, legal or other advice, and should not be relied upon for decision-making purposes without consulting appropriate professionals.
3. Use and Services on the Website
3.1. You undertake to act responsibly when using the Website and to treat other visitors to the Website, its operators and any other party that may be harmed by your use of the Website with respect.
3.2. Use of the Website is for legal purposes only. If the Institute discovers or suspects that you are not making proper use of the Website, it shall be entitled, at its sole discretion, to block your ability to use the services offered on the Website – all or some of them, immediately and without the need for prior notice.
3.3. Talkbacks: In some of the content appearing on the Website, a talkback mechanism operates that is designed to enable fruitful and substantive discussion about them. Without derogating from the provisions of section 2.2 above and the continuation of the terms of use, if you wish to use the talkback mechanism, or any other tool on the Website that allows users to publish content, we hereby clarify that:
3.3.1. Responsibility for the content you publish shall apply to you alone.
3.3.2. It is expressly prohibited to publish, upload or install the following content: content that is not texts, including images, computer code, viruses, spyware, Trojan horses and the like; false, misleading or distorted content; pornographic content or content of an explicit sexual nature; content that infringes copyright or other intellectual property rights of third parties; content that constitutes defamation; content that violates the privacy of others; racist or discriminatory content; content that encourages the commission of criminal offenses or civil wrongs; commercial or advertising content, including covert advertising; content that is harassing, offensive or threatening in nature; links to websites and pages that display content as stated in this section.
3.4. The Institute shall be entitled, at its sole discretion, to delete in full or in part content that violates the terms of use as aforesaid.
3.5. We hereby clarify that user content on the Website does not reflect the Institute’s position, and the Institute is not responsible for it, including its accuracy or correctness. It is recommended to treat it with the required caution.
3.6. If any content that another user on the Website published harms you, we invite you to contact the Institute and we will handle your inquiry promptly.
3.7. Notice and Removal Procedure: If content and/or works that you own are displayed on the Website that you believe infringe your intellectual property rights, including copyrights, violate your privacy, are offensive, inappropriate, constitute defamation or contain pornography, you are invited to contact the Institute with a request for their removal, to the email address davidson@weizmann.ac.il, with a precise reference to the infringing content, details of your claims, attachment of relevant supporting documents and contact details, including email, name and identifying details. If the content is found to be infringing, it will be removed as soon as possible and a notification will be sent to you by email regarding the matter. Since the Institute does not undertake to monitor the content uploaded to the Website by users, the Institute will not be able to know of the existence of infringing content without a request from you. The Institute shall not be liable for infringing content as stated in this section.
3.8. The following content is subject to the following licenses:
3.8.1. Textual content (“Written Content”): The terms of use for written content only (not including images, videos, applets and the like, even if they contain written content) are published under a Creative Commons Attribution-NonCommercial-NoDerivs 3.0 Unported License (“Attribution License”). For the full text of the license.
3.8.2. Written content may be used as is, but may not be edited or otherwise modified. Prominent credit must be given to the Institute in any permitted use thereof, in the following wording: “From the Davidson Institute of Science Education website – at the Weizmann Institute of Science (Nonprofit Organization).”
3.8.3. Images: Images for which no source is specified are permitted for use under the Attribution License. These images may be used as is, but may not be edited or otherwise modified, and prominent credit must be given to the Davidson Institute of Science Education in any use of these images.
3.8.4. It is strictly prohibited to copy or use images from the Shutterstock database, or from any other source other than the Institute, unless the copyright owners of the image have permitted this.
3.8.5. Videos: Videos embedded on the Website from the YouTube website are permitted for use according to the license terms appearing on the YouTube website (usually Creative Commons or standard YouTube license), which can be viewed by clicking on the YouTube caption that appears below the video.
3.8.6. Videos embedded from other websites: If a link to a license appears, check the terms of the linked license. If there is no link to a license, act in accordance with the terms appearing on the website from which the video was taken.
3.8.7. Applets: The use of applets is subject to the terms of use of each applet. In general, applets are prohibited for commercial use, unless such use has been expressly permitted by the copyright owners.
3.8.8. Other than the content detailed above, it is prohibited to copy, duplicate, translate, distribute by any means, publicly display, perform, process, modify, sell, market, rent or make use, whether by yourself or through or in partnership with a third party, in any way or means, of the Website, its content or any part thereof, without receiving in advance written approval from the Institute.
3.9. You bear full and exclusive responsibility for any prohibited use you make of the Website and its content, and undertake to indemnify the Institute for any damage caused as a result thereof.
3.10. The Institute hereby grants you a personal, limited, non-exclusive, non-transferable and revocable license to make personal and non-commercial use of the Website and the Content, subject to these terms of use. Any other use of the Content, including but not limited to, modification, copying, distribution, transmission, display, performance, reproduction, publication, licensing, creation of derivative works, transfer or sale of any item of information, software, product or service originating from the Website, is strictly prohibited.
3.11. Certain actions are prohibited when using the Website. Please read these restrictions carefully. Failure to comply with the following provisions may result in your permission to use the Website being blocked (at the Institute’s sole discretion), and may even expose you to civil and/or criminal liability. You are not permitted (and you are not permitted to allow any third party), unless expressly permitted under these terms of use or unless expressly permitted in writing by the Institute: (a) to use the Website and/or the Content for any illegal, immoral, unauthorized and/or prohibited purpose; (b) to use the Website and/or the Content for commercial or non-private purposes; (c) to remove or separate from the Content and/or the Website any restrictions and marks indicating proprietary rights of the Institute or its licensors, including all proprietary notices appearing therein (such as ©, TM or ®); (d) to violate and/or infringe the rights of users to privacy and other rights, or to collect personally identifiable information about users without their express consent, whether manually or through the use of any robot, spider, crawler or any search or retrieval application, or the use of any other manual or automated means, process or method in order to access the Website and to retrieve, collect and/or mine information; (e) to damage or disrupt the operation of the Website and/or the servers or networks that host the Website, or to violate any law, regulation, requirement, procedure or policy of such servers or networks; (f) to make false statements or misrepresentations regarding your relationship with any person or entity, or to state expressly or by implication that the Institute is associated with you in any way whatsoever, grants sponsorship, supports you, your website, your business or your statements, or to present false or inaccurate information about the Website or the Institute; (g) to perform any action that creates or may create an unreasonably large load on the Website infrastructure; (h) to bypass any measures the Institute uses to prevent or restrict access to the Website; (i) to copy, correct, modify, adapt, transmit, make accessible, translate, refer, reverse engineer, convert binary code to open code, decompile, or separate any part of the Content and/or the Website or to publicly display, create derivative works, perform, distribute or make similar use of the Content and/or the Website; (j) to copy, distribute, display, process, grant a sublicense, make any commercial use, sell, rent, transfer, lend, compile, translate, create a derivative work, perform reverse engineering, integrate with other software – of any material subject to proprietary rights of the Institute, including intellectual property of the Institute, in any manner or by any means; (k) to make any use of the Content on any other website or computer network, for any purpose, without the prior written consent of the Institute; (l) to create a browser environment, frame, create a mirror or perform in-line linking to any part of the Website and/or the Content; (m) to sell, license, or exploit for any commercial purpose any use or access to the Website; (n) to create a database by systematically downloading and storing all or part of the Content; (o) to transmit or otherwise distribute, in connection with the Website or the Content, any virus, “worm”, “Trojan horse”, “bug”, “spyware”, “malware”, or any other computer code, file or software that may harm, or is intended to harm, the operation of any hardware, software, communications equipment, code or component; (p) to use the Website and/or the Content for any unauthorized purpose or that is inappropriate for the purpose of using the Website; and/or (q) to violate any of the Terms.
4. Services Requiring Registration
4.1. Some of the services on the Website require registration. As part of the registration, you may be required to provide personal information. You are not obligated to provide personal information, but in the absence of all the data required to complete the registration, you will not be able to register for these services.
4.2. You may not impersonate or provide incorrect information. Also, do not provide unnecessary personal information – information that you were not asked to provide. By registering for the services, you confirm that the data you provided will be stored and used by the Institute, subject to the provisions of the law and in accordance with the privacy policy.
4.3. In some of the Institute’s services, you must choose a username and password during registration for regular use of the service. Do not share these identification details with anyone other than yourself, to prevent misuse thereof.
4.4. Some of the Institute’s services requiring registration are provided for a fee. Payment may be made through third parties that provide online payment and clearing services, and their use is subject to the terms of use and privacy policy of these third parties, as detailed on their websites.
4.5. The Institute is entitled, at its sole discretion, not to allow you to use the service requiring registration, and also to cancel your registration for the service or block your access to it.
5. Website Availability
Although the Institute has taken reasonable measures to ensure that the Website operates regularly and properly, the ability to preclude defects or disruptions is limited. It is clarified that from time to time there may be service interruptions, malfunctions, disruptions, or deliberate or unexpected outages, including for maintenance, updates, upgrades, service improvement, or other reasons, and the Institute does not undertake that the Website and/or the Services will be available at all times or will operate without interruption, malfunctions or errors. The user shall have no claim, demand or lawsuit against the Institute or anyone on its behalf in connection with the Website’s availability, service interruptions, malfunctions, or disruptions as aforesaid, including for loss of information, loss of income, or any other direct or indirect damage caused to him as a result thereof. The Institute will do its best to minimize the duration and frequency of the interruptions, and will act to repair malfunctions and disruptions reasonably and in accordance with the circumstances.
6. Changes to the Website
The Institute reserves the right to change the Website, its structure, appearance, content, scope of services provided therein or any other change, at its discretion. The user shall have no claim, lawsuit and/or demand against the Institute for making changes as aforesaid and/or for malfunctions or direct or indirect damages that occur as a result of making changes to the Website, including temporary or permanent cessation of the Website’s activity.
7. Cessation of Website Activity and Termination of Terms
The Institute is entitled, at any time and at its sole discretion, to block your access to the Website or part thereof, temporarily or permanently, fully or partially, immediately or after warning, if it becomes clear or a suspicion arises that you are not using the Website in accordance with the Terms, in addition to any other remedy available to the Institute under the law. Also, the Institute is entitled, at its sole discretion, to delete in full or in part content uploaded by you that violates the Terms. In addition, the Institute is entitled at any time, at its sole discretion, to cease the operation of the Website or any part thereof, temporarily or permanently, to delete any information or content uploaded by you to the Website, or to change, correct, improve and make other changes to the Website, without giving prior notice to users. The user agrees and confirms that the Institute shall not be liable for loss of information and/or any damage whatsoever arising from or connected to these decisions. The provisions of these terms of use, which by their nature are intended to continue to exist after the termination of the engagement, shall remain in effect. Without derogating from the generality of the foregoing, the sections dealing with intellectual property, disclaimer of liability, limitation of liability, indemnification and the “General” section shall continue to apply even after the termination of the engagement.
8. Links to the Website and Links to Third Party Websites
8.1. The Website may contain links to other websites that are not operated by the Institute. The links are intended solely for the convenience and information of users. These links are not under the control of the Institute and they do not supervise the content of the linked websites. If the Website contains such links, this does not constitute the Institute’s consent and/or responsibility for the content appearing on the linked websites and/or a guarantee of their reliability, up-to-dateness, proper functioning or legality, and/or the privacy policy and terms of use adopted by their owners. The Institute is not responsible for any consequence caused by the use of the linked websites and/or reliance on them. The Institute recommends carefully reading the terms of use and privacy policy of these websites, if any, and/or contacting the owners of the linked websites in any case of claim or request in the matter. The Institute is entitled, at its sole discretion, to remove any link from the Website and/or add additional links. The Institute does not undertake that the links to said websites will be active and will lead to an active website.
8.2. Links to external websites are not a guarantee that they are safe, quality or reliable websites; visiting them is done at your own discretion only and is within the sole responsibility of the user of the Website. The user shall have no claim and/or lawsuit against the Institute in connection with the content on the Website, including content provided by the Institute and/or third-party content, and also for any direct or indirect damage arising from use and/or entry as aforesaid and/or due to reliance on third-party content and/or due to invasion of privacy following such use.
9. Use of Third Party Data and Services
As part of the Website, the Institute uses data received from applications, platforms and websites owned by third parties. The Institute is not responsible for the quality, reliability, completeness or accuracy of the information of third parties, and any reliance on it is at the sole responsibility of the user.
10. Disclaimer of Liability
10.1. To the maximum extent permitted by law, the Website, Services and Content are provided to users “as is” (AS IS). In addition to the exclusions of liability expressly set forth in these terms of use, each of the Institute, including its suppliers, managers, shareholders, directors, subcontractors, employees, affiliates, subsidiaries, agents, licensors and agents (hereinafter, together: “Institute Representatives”), does not bear any responsibility or obligation of any kind (expressly or by implication), including, but not limited to, responsibility for ownership right or non-infringement or implied responsibility for merchantability or fitness for a particular purpose, as well as responsibility arising from the ordinary course of business or commercial action in connection with the Website, Services and/or Content.
10.2. The Institute does not undertake: (1) that the Website and/or the Content are or will be safe for use, accurate, complete, without malfunctions or interruptions, or free of viruses, defects, “worms”, other harmful components or other software restrictions; (2) that all errors, malfunctions or defects in the Website and/or the Content will be corrected; (3) that the Website will operate continuously, and it is possible and agreed that the Website’s operation will be disrupted or stopped for various reasons. The Institute is entitled, at its sole discretion, to perform maintenance and/or refresh operations on the Website and/or change design and/or any other action that may prevent access to the Website.
10.3. The Institute and Institute Representatives do not bear responsibility and any warranty or condition regarding the use of the Website, including but not limited to, the availability, reliability or quality of the Website. They are not responsible and will not be liable for errors, malfunctions or defects with respect to the Content and/or any information displayed within the Website. The Institute and/or its authorized Institute Representatives shall not be liable for any consequence arising from technical malfunctions (including but not limited to in connection with Internet connectivity, line or server load, delays and related interruptions) arising from Internet and telecommunications providers. The user agrees that the use of the Website and/or the Content is at her sole responsibility. Without derogating from the generality of the foregoing, the Institute and/or its authorized Institute Representatives as aforesaid, shall not be liable for any damage whatsoever, including but not limited to, any damage arising from your use of the Content and/or the Website.
The Institute shall have no responsibility for errors or inaccuracies in any information appearing on the Website. If certain jurisdictions do not permit exclusions or limitations as aforesaid, the exclusions and limitations mentioned above shall not apply in full, but only to the maximum extent permitted under the applicable law.
11. Limitation of Liability
To the maximum extent permitted by law, the Institute, including Institute Representatives, shall not be liable for any damages caused to users or to a third party, of any kind whatsoever, including, direct, indirect, special, punitive, incidental or consequential damages (including, without derogating from the generality of the foregoing, damage to reputation, profits, information, or business and damage for mental anguish), under any legal cause of action (including but not limited to, contractual, tortious, strict liability or other) arising from these terms of use, from the Website and/or the Services and/or the Content, from the user’s use or inability to use the Website and/or the Services and/or the Content, or from any act or omission of the Institute and/or authorized Institute Representatives, based on breach of representations or obligations of the Institute and/or authorized Institute Representatives, arising from or connected to the Terms; all whether the Institute was informed of the possibility that such damage might be caused or not. Without derogating from the generality of the foregoing, and to the maximum extent permitted by law, the cumulative liability of the Institute and/or Institute Representatives for all damages arising from these terms of use or in connection with the user’s use of the Website or the Services or the Content, shall be limited to the amount of NIS 10. If certain jurisdictions do not permit exclusions or limitations as aforesaid, the exclusions and limitations mentioned above shall not apply in full, but only to the maximum extent permitted under the applicable law.
12. Indemnification
Each user agrees to defend and indemnify the Institute and Institute Representatives against any claim, damage, loss, obligation, liability, expense and debt (including but not limited to, attorney’s fees) arising from: (a) her use of the Website and/or the Content not in accordance with these terms of use; (b) any breach on her part of these terms of use; (c) her breach of any right of a third party, including but not limited to, intellectual property rights or the right to privacy in the context of using the Website; and (d) any damage of any kind, whether direct, indirect, special or consequential, caused to a third party that is connected to her use of the Website. It is hereby clarified that the said indemnification obligation shall also apply after the termination of your engagement with the Institute. Without derogating from the generality of the foregoing, we reserve the exclusive right to manage the defense and exclusive control in any matter and proceeding related to indemnification on your part, in a manner that does not derogate from the user’s obligation as aforesaid, and requires her to fully cooperate with us in managing such proceeding. The user confirms that she will not agree to a settlement in any matter subject to indemnification by her without receiving our prior written consent thereto.
13. Privacy Policy
The Institute respects the privacy of users and is committed to protecting the personal information that users share with it. The Institute believes that users have the right to know its policy regarding the collection and use of information received by it during use of the Website. The policy of collecting information of various types is described in the Institute’s privacy policy, located at: [Privacy Policy], and constitutes an integral part of these terms of use. The user agrees and confirms that the Institute may use personal information collected by the Institute in the context of her use of the Website in accordance with the privacy policy. If the user intends to enter and/or use the Website, she must read and agree to the privacy policy before using the Website.
14. Intellectual Property
14.1. All intellectual property rights in the Website, in the Services, in all Content on the Website, including trademarks, copyrights, goodwill, ownership rights in information including distribution rights and any other intellectual property of the Institute (hereinafter, together: “the Intellectual Property”) are the property of the Institute alone or of third parties from whom the Institute received a lawful license for use. Any right not expressly granted to the user under these Terms shall be reserved by the Institute and/or its licensors. The Terms do not grant the user rights in the Institute’s Intellectual Property, but only a limited and revocable right to use the Website in accordance with the Terms. No provision in the Terms constitutes a waiver of the Institute’s intellectual property under any law.
14.2. If you provide us with feedback, comments or any suggestion regarding the Website and/or the Content (“Feedback”), the Institute shall receive an exclusive, perpetual, royalty-free, worldwide and irrevocable license to incorporate the Feedback into any current or future services of the Institute, and shall also be entitled to use the Feedback for any purpose whatsoever, all without providing the user with any consideration and without receiving approval from the user. The user confirms that the Feedback shall not be considered confidential information. Also, the user declares that the Feedback is not subject to license terms that would require the Institute to meet additional obligations in connection with its services incorporating the Feedback.
14.3. The Institute’s marks, logos and other proprietary identifiers used by the Institute in connection with the Website (hereinafter: “the Institute’s Trademarks”) are all trademarks and/or trade names of the Institute, whether registered or not, and whether registrable or not. All other trademarks, trade names, other identifying marks and other commercial symbols (including any logo) that may appear on the Website belong to their respective owners (“Third Party Trademarks”). Third Party Trademarks appear on the Website (if at all) for purposes of display, description and identification only. No right, license or interest in the Institute’s Trademarks or in Third Party Trademarks is granted hereby. The user confirms that she will refrain from any use of these marks, unless otherwise expressly permitted in the Terms.
15. Miscellaneous
(a) These Terms constitute the complete understandings and conditions agreed between you and the Institute in connection with the matters appearing in these Terms, and they override any other agreements, prior or valid, written or oral, between you and the Institute, (b) any claim in connection with the Website/Content or their use, shall be subject to the laws of the State of Israel, and shall be interpreted according to these laws (without giving effect to the rules of international conflict of laws set forth therein), and the United Nations Convention on Contracts for the International Sale of Goods shall not apply to it either, (c) any dispute arising from or related to your use of the Website shall be brought for adjudication in the competent courts in the Tel Aviv District, Israel, and you hereby agree to the exclusive and local jurisdiction of these courts. You agree to waive all defenses regarding lack of personal jurisdiction and forum non conveniens, and agree that court documents will be served in the manner permitted under applicable law and/or by court order. Notwithstanding the foregoing, the Institute may seek injunctive relief in any competent court, (d) these Terms do not create and shall not be construed as creating a partnership relationship, joint venture, employer-employee relationship, agency relationship or franchisor-franchisee relationship between the parties, (e) no waiver by any party of any breach or default under this Terms agreement shall be deemed a waiver of any breach or default, whether prior or subsequent, (f) any section heading or any other heading in these Terms is provided for convenience only, and does not define or explain any section or provision contained in these Terms, (g) you confirm and agree that any cause of action you may have, arising from or relating to the Website and/or the Content, shall be available to you for one (1) year from the date of the occurrence of the event. After this period, it is hereby agreed between the parties that this cause of action shall be time-barred, (h) if it is determined by a competent body that any provision of these terms of use is illegal, void or for any reason cannot be enforced, then this provision shall be deemed a provision that can be limited or separated from these Terms, and said provision (to the maximum extent possible under the law) shall not affect the validity and ability to enforce any of the remaining provisions of these Terms, (i) you may not assign, grant a sublicense or otherwise transfer your rights or your obligations, all or any of them, under these Terms without our prior written consent. We may assign or transfer our obligations under these Terms without restriction and without notice thereof, (j) any amendment to these terms of use shall not have binding legal force unless made in writing and signed by the Institute, and (k) the parties agree that all correspondence relating to these Terms shall be in writing (by email or regular mail), in Hebrew or English.
