Terms of Use for Users of the

Davidson Institute of Science Education Website

The following Terms of Use apply to the website of the Davidson Institute of Science Education at the Weizmann Institute of Science (R.A.) (hereinafter: the “Website” and the “Institute,” respectively). The Website is managed and operated by the Institute and is open for use in accordance with the terms set forth herein. Access to the Website, browsing it, use of the services offered on it, and any other use of the Website are subject to these Terms of Use and the Privacy Policy (the “Terms of Use”). Access to the Website, browsing it, use of any service offered on it, or any other use thereof, indicates your consent to the Terms of Use. Please read the Terms of Use carefully before browsing the Website or making any other use of it. It is important to re-read them from time to time as they may change. If you do not agree to the Terms of Use, we ask that you leave the Website and refrain from using it in any manner whatsoever.

1. General

1.1 The Website is primarily intended to provide scientific information, science education information, information about science education activities (“Activities”), and information about the activities of the Davidson Institute of Science Education. The Website includes extensive information in a variety of fields, including links to sub-sites of units operating under the Institute and to the Weizmann Institute of Science website. The Website also includes information services (newsletters), as well as additional tools and services, such as: online registration for certain Activities, talkbacks that allow users to respond to some of the content published on the Website, and more (“Services”). Some of the Services and Activities are subject to additional terms beyond the Terms of Use, such as: regulations, registration terms, and more, which apply in addition thereto.

1.2 The Website, including the content and Services therein, is offered for use as is, with its features and limitations, and you shall have no claim, demand, or cause of action against the Institute or anyone on its behalf regarding the Website’s features, limitations, or available options, or in connection with its suitability to your needs and requirements.

1.3 Privacy Policy: The Institute respects the privacy of visitors to the Website. The Privacy Policy, as it appears on the Institute’s website, is an integral part of the Terms of Use. Please re-read this Policy from time to time as it may change.

2. Proper Use of the Website

2.1 You undertake to act responsibly when using the Website and to treat other visitors to the Website, its operators, and any other party that may be harmed by your use of the Website, with respect.

2.2 Use of the Website is intended for lawful purposes only. If the Institute discovers or suspects that you are not making proper use of the Website, it shall be entitled, at its sole discretion, to block your ability to use the Services offered on the Website—in whole or in part, immediately and without the need for prior notice.

2.3 Talkbacks: Some of the content appearing on the Website features a talkback mechanism designed to enable productive and relevant discussion thereon. Without derogating from the provisions of Section 2.2 above and the remainder of the Terms of Use, if you wish to use the talkback mechanism, or any other tool on the Website that allows users to publish content, we hereby clarify that: Responsibility for the content you publish shall rest solely with you. It is expressly prohibited to publish, upload, or install the following content:

2.3.1 Content that is not text, including images, computer code, viruses, spyware, Trojan horses, and the like.

2.3.2 False, misleading, or distorted content.

2.3.3 Pornographic content or content of a blatantly sexual nature.

2.3.4 Content that infringes upon copyright or other intellectual property rights of third parties.

2.3.5 Content that constitutes defamation.

2.3.6 Content that violates the privacy of others.

2.3.7 Racist or discriminatory content.

2.3.8 Content that encourages the commission of criminal offenses or civil wrongs.

2.3.9 Commercial or advertising content, including covert advertising.

2.3.10 Content that is harassing, offensive, or threatening in nature.

2.3.11 Links to websites and pages that display content as specified in subsections 1–10 above.

2.4 The Institute shall be entitled, at its sole discretion, to delete in whole or in part content that violates the Terms of Use as aforesaid.

2.5 We hereby clarify that user content on the Website does not reflect the position of the Institute, and the Institute is not responsible for such content, including its accuracy or correctness. It is advisable to treat such content with the requisite caution. If any content published by another user on the Website offends you, we invite you to contact the Institute, and we will address your inquiry promptly.

3. Intellectual Property

3.1 The copyright and all other intellectual property rights in the Website, including the rights to the Services and content contained therein, except for content published by users on the Website, as well as the trade names and trademarks therein, are the exclusive property of the Institute or of third parties from whom the Institute has lawfully obtained a license to use them, unless expressly stated otherwise.

3.2 Publication of content by users on the Website: By publishing content on the Website: (1) You represent and warrant that you are authorized and entitled to publish the content, and that the copyright to such content belongs to you, or that you have lawfully obtained permission to publish it and to grant the Institute a license as detailed below; (2) You grant the Institute an irrevocable, worldwide, and perpetual license to use the content, copy it, distribute it, publish it in any medium, including print, other websites, additional locations on the Website, applications, Institute publications, and so forth, modify it, and create derivative works therefrom. If you believe that any content published on the Website infringes your rights, we invite you to contact the Institute, and we will address your inquiry promptly.

4. Use of the Website

4.1 Use of the Website is permitted for your personal purposes only and subject to these Terms of Use. It may not be used for commercial purposes or for any other use not expressly permitted in the Terms of Use.

4.2 The Terms of Use apply to use of the Website, including the content contained therein. The term “content” or “contents” includes, but is not limited to, databases, graphic design, information of any kind, including: articles, essays, reviews, data, news, analyses, columns, annotations in the text: images, videos, computer software, databases, and audio files that will be made available to users on the Website, and any other element related to the operation of the Website.

4.3 The following content is subject to the licenses set forth below:

4.3.1 Textual content (“Written Content”): The terms of use for Written Content only (excluding images, videos, widgets, and the like, even if they contain Written Content) are published under a Creative Commons Attribution-NonCommercial-NoDerivs 3.0 Unported License (“Attribution License”). For the full text of the License. Written Content may be used as is, but may not be edited or otherwise modified. Prominent credit must be given to the Institute for any permitted use thereof, in the following format: “From the Davidson Institute of Science Education website.”

4.3.2 Images: Images for which no source is indicated may be used under the Attribution License. Such images may be used as is, but may not be edited or otherwise modified, and prominent credit must be given to the Davidson Institute of Science Education for any use of such images. It is strictly prohibited to copy or use images from Shutterstock, or from any other source other than the Institute, unless the copyright owners of the image have permitted such use.

4.3.3 Videos: Videos embedded on the Website from YouTube may be used in accordance with the license terms appearing on YouTube (usually Creative Commons or standard YouTube license), which can be viewed by clicking on the YouTube caption appearing below the video. Videos embedded from other websites: If a link to a license is provided, the terms of the linked license must be checked. If no link to a license is provided, the terms appearing on the website from which the video was taken must be followed.

4.3.4 Widgets: Use of widgets is subject to the terms of use of each widget. As a general rule, widgets may not be used for commercial purposes unless such use has been expressly permitted by the copyright owners. Apart from the content detailed above, no content may be copied, duplicated, translated, distributed by any means, publicly displayed, performed, processed, modified, sold, marketed, rented, or used, whether by you or through or in cooperation with a third party, in any manner or by any means, on the Website, its content, or any part thereof, without prior written approval from the Institute.

4.4 You bear full and exclusive responsibility for any prohibited use you make of the Website and its content, and you undertake to indemnify the Institute for any damage caused as a result thereof.

5. Services Requiring Registration

5.1 Some of the Services on the Website require registration. As part of the registration process, you may be required to provide personal information. You are not obligated to provide personal information; however, in the absence of all the data necessary to complete the registration, you will not be able to register for these Services.

5.2 You may not impersonate others or provide inaccurate information. Furthermore, you may not provide unnecessary personal information—information that you were not asked to provide. By registering for Services, you confirm that the data you have provided will be stored and used by the Institute, subject to the provisions of the law and in accordance with the Privacy Policy.

5.3 For some of the Institute’s Services, you are required to choose a username and password during registration for ongoing use of the Service. You must not disclose these identification details to anyone other than yourself, in order to prevent their misuse.

5.4 Some of the Institute’s Services requiring registration are provided for a fee. Payment may be made through third parties that provide online payment and clearing services, and use thereof is subject to the terms of use and privacy policy of such third parties, as detailed on their websites.

5.5 The Institute may, at its sole discretion, refuse to allow you to use a Service requiring registration, as well as cancel your registration for a Service or block your access thereto.

6. Links and References to Information Outside the Website

6.1 Linking to the Website’s home page is permitted from websites that are not prohibited. “Prohibited websites” are pornography websites, websites that encourage or serve as a platform for illegal activity, racist websites, and hate websites.

6.2 The Website, internal pages on the Website, and any other content appearing thereon, in whole or in part, may not be linked to in any manner that may create the appearance of sponsorship by or affiliation with the Institute. This includes creating deep links to Website content, displaying such content in frames, or performing any other action that integrates Website content within or alongside content outside the Website, or displaying trademarks or names of entities other than the Institute alongside such content—unless you have received prior written consent from the Institute to do so. The Institute reserves the right to revoke its consent and demand the removal of links to the Website at its sole discretion.

6.3 Unless expressly stated otherwise, external websites to which links are provided from the Website are not under the control or supervision of the Institute, and the sole purpose of such links is to enable convenient browsing on the Internet. The Institute has and shall have no responsibility for the content or activities of external websites. The Institute does not undertake that the links on it will indeed lead to valid and active external websites, and in any event, the Institute shall not be liable for any damage, loss, or inconvenience caused as a result of using a link to an external website.

7. Liability and Indemnification

7.1 The Website and the Services therein are intended for use as is. The Institute bears no liability whatsoever, express or implied, direct or indirect, except for the requirements and prohibitions imposed upon it by law. Use of the Website is conditional upon your express consent that use thereof is at your sole risk.

7.2 The Institute does not undertake to keep the Website and the Services therein available at all times and does not undertake to maintain their quality. This includes that the Institute does not undertake that the Website and the Services therein will function properly, will be free of errors or interruptions, or that any result will be obtained from use of the Website.

7.3 The Institute is not and shall not be liable for any damage whatsoever (including: direct, indirect, consequential, special, or any other type of damage), loss, expense, inconvenience, or loss caused as a result of using the Website or as a result of the inability to use it or any content and Services contained therein.

7.4 The Institute is not and shall not be liable for any content uploaded to the Website by users.

7.5 The Website may offer software that can be downloaded to a personal computer, or links to websites that allow such software to be downloaded. Unless expressly stated otherwise, the Institute is not the developer of such software and does not examine its quality, and the link thereto does not indicate its reliability or suitability for your needs, including the computer model and operating system you have. Downloading such software to your computer shall be done at your full and exclusive responsibility, and use thereof is subject to the license terms contained therein.

7.6 You undertake to indemnify the Institute, its employees, directors, or anyone on its behalf for any damage, loss, lost profits, payment, or expense caused to them as a result of your breach of the Terms of Use set forth herein, including any claim, demand, or lawsuit by a third party filed against the Institute due to your use of the Website, including publishing content on the Website, registering for Services on the Website, placing links to the Website, or any other action related to the Website.

8. Changes to the Website and Discontinuation of Website Operation

8.1 The Institute may change the structure, appearance, and design of the Website from time to time, as well as the scope and availability of the Services therein, at its sole discretion. The Institute may, but is not obligated to, publish advance notice thereof.

8.2 The Institute may discontinue or restrict the Services on the Website, or any part thereof, at any time, temporarily or permanently, at its sole discretion. The Institute may, but is not obligated to, publish advance notice thereof.

8.3 Changes, discontinuations, or restrictions as aforesaid may involve malfunctions or inconvenience. You shall have no claim, demand, and/or cause of action against the Institute for making such changes or for malfunctions that occur in the course of making them.

9. Updates to the Website Terms of Use

The Institute reserves the right to change the Terms of Use of the Website from time to time, at its sole discretion. Any change to the Terms of Use of the Website shall take effect immediately upon updating the change on the Terms of Use page of the Website. Your continued use of the Website after the update of the Terms of Use shall be deemed your consent to the updated Terms of Use. If you do not agree to the updated Terms of Use of the Website, we ask that you leave the Website and refrain from making any use of it or its Services.

10. Governing Law and Jurisdiction

Use of the Website shall be governed solely by the laws of the State of Israel, without giving effect to conflict of laws provisions. Exclusive jurisdiction in any matter relating to the Website, including the Terms of Use of the Website, shall be vested in the competent courts in the Tel Aviv-Jaffa district.
